    DMCA Notice & Takedown

    Farouk Fusion respects intellectual-property rights and expects users of farouks-fusion.com, EFURC, EFER, EFEMM, and JKPHermex to do the same. This page explains how to notify us of alleged copyright infringement under the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512, and how we process takedowns, counter-notices, and the EFURC card-fan-art carve-out.

    1. Designated agent

    Our designated agent to receive notifications of claimed infringement under 17 U.S.C. § 512(c)(2) is:

    2. Submitting a takedown notice (the 6 required elements)

    To be effective under 17 U.S.C. § 512(c)(3), your notification must include all six of the following. Incomplete notices may be rejected.

    1. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notification.
    2. Identification of the infringing material with enough information for us to locate it (URL, post ID, screenshot, or the exact EFURC card / EFER lore entry / EFEMM profile / JKPHermex transcript reference).
    3. Your contact information: full legal name, mailing address, telephone number, and email address.
    4. A statement of good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
    5. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorised to act on the copyright owner’s behalf.
    6. Your physical or electronic signature (a typed name in the email body is acceptable for electronic submission).

    2.1 Optional template

    While not required, the following structure helps us process your notice quickly:

    3. How we process a valid takedown

    1. Acknowledge: we send an acknowledgement within 2 business days.
    2. Remove or restrict: we remove or restrict access to the allegedly infringing material within 5 business days, and notify the uploader.
    3. Document: we keep a record of the takedown as required by § 512(b) for the duration of the dispute.
    4. Counter-notice option: we tell the uploader about their right to submit a counter-notice (see Section 5).

    If the notice is incomplete or facially defective, we will tell you which element is missing so you can correct and resubmit.

    4. Repeat-infringer policy

    Under § 512(i)(1)(A), Farouk Fusion maintains a policy of terminating access for users who are repeat infringers. We define a repeat infringer as an account that has had three or more distinct valid takedowns against it within a rolling 12-month period. After the third strike the account is permanently banned from upload and posting; further strikes result in full account termination. We may grant one appeal per user, decided by a human reviewer who was not part of the original strike decisions.

    5. Counter-notice procedure

    If you believe content removed under a takedown notice was the result of a mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). Your counter-notice must include:

    1. Your physical or electronic signature.
    2. Identification of the material that was removed or disabled, and the location at which it appeared before removal.
    3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
    4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which Farouk Fusion may be found), and that you will accept service of process from the person who submitted the original takedown or their agent.

    Send the counter-notice to osei1sup@gmail.com. We will forward it to the original complainant. Unless the complainant files a lawsuit seeking a court order within 10–14 business days, we will restore the removed material at our discretion.

    6. EFURC card fan-art & UGC carve-out

    EFURC is a community game, and fan-art of EFURC cards is one of the most common categories of UGC. The following carve-outs reduce friction while still protecting rights:

    • Non-commercial fan-art of EFURC cards (drawings, paintings, cosplay photos, mods for personal use) is welcome on EFER/EFEMM community spaces and will not normally trigger a takedown unless the rights-holder asks for removal.
    • EFURC deck codes and strategy guides are not copyrightable as such; we accept the underlying mechanics but not the verbatim text of lore descriptions longer than 200 words without permission.
    • EFEMM character profiles are derivative of canonical lore; original characterisation in fan profiles is encouraged, but wholesale copying of canonical text is not.
    • AI-generated JKPHermex conversations are not the copyright of the user; see our Terms and Privacy Policy for how they may be used.

    If you are the rights-holder of EFURC, EFER, or EFEMM content and want a takedown of fan-work, send a notice per Section 2 and we will action it under our normal process.

    7. Trademark and other IP complaints

    Trademark, patent, trade-secret, and right-of-publicity complaints use the same channel (osei1sup@gmail.com) and a substantively similar procedure; please mark the subject line accordingly. We respond within 10 business days.

    8. Misrepresentations

    Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing (or that it was removed by mistake) may be liable for damages, including attorneys’ fees. Make sure your claim is accurate before submitting.

    9. Good-faith / counter-notice safety

    We do not penalise users for submitting takedowns or counter-notices in good faith. If we determine a notice was submitted in bad faith, we reserve the right to suspend the submitter’s account.

    11. International equivalents

    The DMCA procedure is U.S.-specific. If you are outside the U.S. and want to report infringement, you may still use the same email (osei1sup@gmail.com) and we will handle it under the same standards. Common international frameworks include:

    • EU Copyright Directive (EU) 2019/790 — Article 17 obligations apply to online content-sharing service providers. While farouks-fusion.com is not a “content-sharing service provider” within the meaning of Article 17, we voluntarily apply DMCA-equivalent standards to all jurisdictions we serve.
    • UK Online Safety Act 2023 — imposes content-reporting duties. Our Acceptable Use Policy covers the prohibited-content categories that overlap with this Act.
    • Canadian Copyright Act — the notice-and-notice regime applies to intermediaries. We comply on a best-efforts basis.
    • Australia Copyright Act 1968 (Part VAA) — fair-and-balanced takedown procedures; we apply DMCA-equivalent timelines.

    12. Anti-abuse and abuse of process

    If we determine that a takedown notice or counter-notice was submitted in bad faith, knowingly materially misrepresented the facts, or is part of a pattern of abuse, we may:

    • Reject the notice and notify the sender in writing.
    • Suspend the sender’s account for repeated abuse (see our Acceptable Use Policy).
    • Where appropriate, seek recovery of our costs and reasonable legal fees under 17 U.S.C. § 512(f).

    13. What we do NOT cover

    This page is about copyright and intellectual-property takedowns. It is not the channel for:

    • Privacy or data-protection complaints — use osei1sup@gmail.com.
    • Trademark complaints in jurisdictions outside the U.S. — these are still welcome at osei1sup@gmail.com but follow their local rules.
    • Defamation / right-of-publicity claims — these are reviewed by counsel and responded to within 30 days.
    • General customer-support requests — see farouks-fusion.com/support.

    14. Updates

    This page may be revised from time to time. Material changes are announced in advance via in-app notice; the “Last updated” date at the top reflects the most recent revision.
