Terms of Service
These Terms of Service (“Terms”) form a binding agreement between you and Farouk Fusion (“Farouk Fusion,” “we,” “us,” or “our”). They govern your use of farouks-fusion.com, the EFURC Unreal Engine 5 card-battler, the EFER and EFEMM universe sites, the JKPHermex AI assistant on Android, and any related websites, mobile apps, and services (together, the “Services”). By creating an account, installing an app, or using any Service, you agree to these Terms and to our Privacy Policy, Acceptable Use Policy, and Cookie Policy.
1. Acceptance and eligibility
You must be at least 13 years old (16 in jurisdictions where local law requires a higher age) to use the Services. By using the Services, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts
To use most features you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately at osei1sup@gmail.com if you suspect unauthorized use. Farouk Fusion is not liable for losses caused by unauthorized account use that you could have prevented by reasonable safeguards.
3. License to use the Services
Subject to your compliance with these Terms, Farouk Fusion grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Services on devices you own or control, solely for your personal, non-commercial entertainment and information purposes, except as expressly permitted by an enterprise agreement you have signed with us. You may not sublicense, resell, or commercially exploit the Services.
4. Content ownership
4.1 Your user-generated content (UGC)
You retain all rights you already hold in content you create and upload to the Services — including EFURC deck codes you share publicly, EFER lore posts, EFEMM character profiles and fan-art, and JKPHermex conversations you export. You grant Farouk Fusion a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, reproduce, modify for formatting, publish, and display that UGC solely to operate, promote, and improve the Services. You can revoke this license for a specific item by deleting it or by emailing osei1sup@gmail.com; we will cease non-archived use within 30 days.
4.2 Our platform content
All other content in the Services — including the EFURC engine, EFER and EFEMM artwork and lore, the JKPHermex model weights, the Fusion brand, trademarks, logos, and any software or documentation — is owned by Farouk Fusion or its licensors and is protected by copyright, trademark, and other laws. You may not copy, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, or store any of our content except as incidental to normal use of the Services or as required by applicable law.
4.3 Feedback
If you send us feedback or suggestions, we may use them without restriction or compensation to you.
5. Virtual items and currency
EFURC and other Farouk Fusion games may offer virtual currency (“FusionCoins“), crafting resources (“Spark“), booster packs, cosmetics, or other digital items (“Virtual Goods”). Virtual Goods have no real-world monetary value, are licensed (not sold), cannot be redeemed for cash, and are not transferable between accounts except as the game allows. Prices and availability may change. We may modify or sunset Virtual Goods at any time, but we will honor already-purchased entitlements for the lifetime of the Service. In-game balances granted as part of a promotion or daily login are non-refundable and have no cash value.
6. Purchases, taxes, and refunds
If you buy Virtual Goods through the Apple App Store or Google Play Store, the sale is between you and Apple or Google respectively, and their respective purchase terms apply. Farouk Fusion sets prices but does not directly process the payment. Refunds for App-Store purchases are handled by Apple under Apple’s refund policy; refunds for Play Store purchases are handled by Google under Google’s refund policy. Direct purchases on farouks-fusion.com are processed by Stripe or RevenueCat; you may request a refund within 14 days of purchase if the Virtual Goods have not been used, in line with EU consumer law (2011/83/EU). Mandatory legal withholding taxes may apply depending on your jurisdiction.
7. Acceptable Use
Your use of the Services must comply with our Acceptable Use Policy, which is incorporated into these Terms. Violations may result in content removal, suspension, or permanent ban.
8. AI assistant (JKPHermex) disclaimer
JKPHermex is an AI assistant that uses large language models to produce conversational replies. JKPHermex can make mistakes. Outputs may be inaccurate, incomplete, outdated, or inappropriate even though we have safety filters. You are responsible for verifying any information JKPHermex provides before relying on it, especially for medical, legal, financial, or safety-critical decisions. Do not input personal data about others, confidential information, or content you do not have the right to share. JKPHermex is provided “as is” without warranties of any kind.
9. Beta and pre-release features
We may invite you to try beta or experimental features. These are provided for evaluation, may be modified or withdrawn at any time, may contain bugs, and are governed by an additional beta terms notice if you opt in.
10. Suspension and termination
We may suspend or terminate your account, or restrict access to specific Services, at any time if we reasonably believe you have violated these Terms, the Acceptable Use Policy, or applicable law; if required by a legal process; or to protect the safety of other users or the integrity of the Services. Where appropriate, we will give you advance notice and an opportunity to cure. You may terminate these Terms at any time by closing your account via the in-app settings or by emailing osei1sup@gmail.com.
11. Warranty disclaimer
To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services will meet your particular requirements.
12. Limitation of liability
To the maximum extent permitted by law, in no event will Farouk Fusion, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the Services. In jurisdictions that do not allow the limitation of certain damages, our aggregate liability for all claims arising under or relating to these Terms will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to liability, or (b) USD $100. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including death, personal injury caused by negligence, or fraud).
13. Indemnification
You agree to indemnify and hold Farouk Fusion and its affiliates harmless from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from your use of the Services in violation of these Terms, your UGC, or your violation of any applicable law.
14. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles, except where mandatory local consumer-protection laws of your habitual residence apply.
15. Dispute resolution — arbitration
We want to resolve disputes quickly and amicably. Informal resolution first: before filing any formal claim, you agree to email osei1sup@gmail.com with a description of your dispute and your contact information. We will try to resolve it by contacting you via email within 30 days. Arbitration: if unresolved, any dispute (excluding injunctive relief and small-claims matters) will be settled by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration will be conducted by a single arbitrator in Delaware, USA, in English. The arbitrator’s award is final and may be entered as a judgment in any court of competent jurisdiction. Class-action waiver: you and Farouk Fusion each waive the right to participate in a class, collective, or representative action. EU/UK consumers: nothing in this section removes your right to bring proceedings in the courts of your habitual residence or to rely on mandatory consumer-protection law of your country.
16. Changes to these Terms
We may revise these Terms from time to time. The “Last updated” date at the top records the most recent change. If a change is material, we will give you at least 14 days’ notice by in-app message or email. Continued use after the effective date constitutes acceptance; if you do not agree to a change, you may terminate these Terms by closing your account before the effective date.
17. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms are the entire agreement between you and Farouk Fusion regarding the Services and supersede all prior or contemporaneous communications on the same subject.
